Terms Of Service At The Zloto – Orla Online Store


§ 1 INITIAL PROVISIONS

1.1 These Terms of service lay down rules for the use of the ZLOTO - ORLA online store, including entering and fulfilling sales contracts through this service.

1.3 The term of usage of the Zloto - Orla online store is the prior approval of these terms of service and a commitment to its principles.

1.4 Agreements may by entered by any natural person having full legal capacity, registered in the online store.

§ 2 PLACING AN ORDER

2.1 Placing an order in the Zloto - Orla online store is possible with the following steps:

* Registering by providing personal data, protected by our privacy clause

* Loging in

* Accepting the goods put into cart

2.2 Customer is required to properly fill out the registration form and to include the address information in accordance with reality.

2.3 Orders may be placed round the clock, but their acceptance will undergo during the shop administrator working hours, that is from Monday to Friday from 10am to 6pm.

2.4 Customer is bound with the contract agreement for a period of 14 working days from the date of its filing.

2.5 Taking the order is made by Zloto - Orla employee and is confirmed by e-mail. In the case of lack of chosen product or other independent reasons, such as price change, our employee notifies the customer by e-mail or phone about the situation.

2.6 Zloto – Orla reserves the right to refuse order realisation in case of doubts, such as wrongly filled registration form, or and in the cases mentioned in paragraph 2.5.

2.6 The customer can modify or cancel his order within 24 hours by phone or email.

2.7 Both parties agreeably exclude the possibility of withdrawal of orders and major changes in the case of goods made upon special request.

§ 3-ORDER COMPLETION TIME

3.1 The order is processed within 5 working days from the date of posting the deposit on our bank account.

3.2 In the case of COD shipment processing time is counted from the date of e-mail confirmation of the selected option.

3.3 In the case of goods tagged with the words "special order", the customer should contact with us to get the current waiting time.

3.4 Each order is equipped with a document evidencing the sales contract, or receipt. We issue invoices on request.

§ 4 PAYMENTS

4.1 Customer shall pay for the ordered goods the total amount plus any shipping costs on behalf of the store:

4.2 Lack of transfer within 10 days from order will effect in cancelling of the order.

4.3 There is an option of cash payment while in the store at 13 Orla Street in Warsaw, when choosing the option of personal collection.

§ 5 DELIVERY

5.1 There is an option of personal collection at Zloto – Orla store at 13 Orla Street in Warsaw (corner of Aleja Solidarnosci 95/99).

5.2 Zloto - Orla store ships the orders by Pocztex courier service.

5.3 The customer is obliged, in the presence of the courier, to check the package if it has not been damaged. If the package was damaged, he should check the contents, and if necessary, write down a report, which will serve as basis for any claim.

5.4 The Customer takes full responsibility for damage or loss of goods upon receiving the shipped order.

5.5 Zloto - Orla covers the costs of commission goods shipment.

5.6 The costs of foreign shipments are calculated individually.

5.7 Zloto - Orla store is not responsible for not keeping the terms due to any reasons beyond its control, in particular the cases of force majeure. In this case the customer is notified by e-mail or phone about the situation and has the ability to withdraw from the sales contract.

5.8 If the customer does not receive the goods within 14 working days and doesn’t contact the store, then the order is cancelled, and any amount paid shall be refunded to the account from which payment was made.

5.9 On customer’s request, we can hand over or send the goods to another person or to a different address than that filled in the registration. In that case, please notify the store by e-mail or phone prior to the shipment, supplying us with the exact data of the person authorized to receive the goods.

§ 6 RETURN AND CLAIM

6.1 The customer has the right to return the goods within 10 working days from receiving them, without giving any reason within the meaning of the Act of 2 March 2000 on the protection of some consumer rights and liability for damage caused by a dangerous product. (Ustawa z dnia 2 marca 2000 r. o ochronie niektorych praw konsumentow oraz o odpowiedzialnosci za szkodę wyrzadzona przez produkt niebezpieczny „Dz. U. z dnia 31 marca 2000 r.”)

6.2 Goods must be returned in full kit, original packaging and with intact tag, receipt or invoice. Goods cannot have signs of use.

6.3 In the case described in paragraph 6.2, the customer receives the amount equal to the product value within 14 days of receiving the return by Zloto - Orla. Shipment costs are covered by the customer.

6.4 The goods must be accompanied by a written statement of withdrawal from the sale - purchase agreement.

6.5 The return shall not include goods ordered on special request, closely related to the purchaser, for example - containing an engraving.

6.7 In case of return of jewellery with precious stones or pearls, the act of return must be preceded by a study conducted by an expert – gemmologist and by his favourable opinion.

6.8 Under current law the customer has two years to claim the goods in the event of a product defect.

6.9 Claim should be sent to Zloto – Orla headquarters with a note “Claim - online store”.

6.10 Together with the claimed goods customer should attach the claim form and a photocopy of receipt or invoice.

6.11 The cost of delivering the claimed goods is covered by the customer.

6.12 Reply to the claim is provided within 14 days from the date of claimed goods delivery to the Zloto – Orla store.

6.13 In the event of defects resulting from improper manufacture, repair costs are covered by the Zloto – Orla store, but in case of damages (damages due to the customer’s fault or due to random events that occur during use, such as mechanical damage, scratches and bends) our employee will contact the customer to inform of any repair costs.

§ 7 NEWSLETTER

7.1 The customer has an opportunity of receiving the latest information on Zloto – Orla store, offered goods and promotional campaigns on previously provided e-mail address.

7.2 The customer may at any time opt out of receiving the newsletter.

§ 8 PERSONAL DATA

8.1 By registering in the Online Store the customer consents to the collection and processing by Zloto – Orla of his by personal data provided in the form under the Protection of Personal Data Act (Ustawa z dnia 29 sierpnia 1997 r. o ochronie danych osobowych (Dz. U. z 2002 r. nr 101 poz. 926 z pozn. zm.)) solely for the purpose of the sales contract. The access to these data is possible only for a few authorized persons. Your personal data will not be provided, sold or lent to others.

8.2 The customer can also opt to receive the Zloto - Orla information of advertising and commercial nature, including by means of electronic communication.

8.3 The customer is entitled to inspect the contents of his personal data and correct them, or to request their deletion.

Personal data are protected under the "Protection of personal data" Act (Ustawa z dnia 29.08.1997 r. "O ochronie danych osobowych" (Dz.U. Nr 133 poz. 883)) preventing access by third parties.

§ 9 FINAL PROVISIONS

9.1 To all matters not settled in the Terms of Service, the provisions of the Civil Code are applicable, as well as the provisions of the Act on the specific conditions of consumer sale and amendments to the Civil Code and the Act on protection of consumer rights and liability for damage caused by dangerous products.
